Divorce

Every divorce is different, due to the details and the personalities involved. That is why successfully negotiating a divorce requires careful attention to detail and a thorough understanding of the client’s situations and goals. Calling on over 20 years of experience with a wide range of divorce cases, Coldwell | Bowes, L.L.P. will work to keep your case from getting out of control, and will do what is needed to achieve the goals you have for you and your family’s futures.
Collaborative Divorce

In some cases, litigating a divorce may not be the best option for the parties involved. Many couples are beginning to look for more solutions-oriented options when entering into a divorce. For these couples, collaborative divorce may be an appropriate strategy. In a collaborative divorce, couples agree to three conditions:

  1. All issues will be settled out of court with the assistance of attorneys and other specialists trained in the collaborative process.
  2. Both parties must act in good faith and engage in a transparent process, with full disclosure of all relevant information.
  3. Both parties will negotiate with mutual respect and with the goal of reaching a solution that is in the best interest of all, especially children.
The lawyers at Coldwell | Bowes are committed to guiding couples through every step of this process, including gathering information, employing necessary experts, and negotiating appropriate solutions.

Complex Property Division

Many divorces include complex property issues, including the identification of separate property as well as the division of various marital assets and debts. These issues may also include the valuation and division of businesses, retirement accounts, investment portfolios, real estate, or other holdings. We often work with a team of financial professionals, to help determine the true value of your assets and will work towards establishing a solid financial future for you and to ensure that you are not deprived of property that is rightfully yours.

Protective Orders

In some situations, additional measures need to be taken to ensure your safety and/or the safety of your children. In these situations, we can work quickly on your behalf to ensure that you and your family are afforded all of the protection that the legal system offers you.

In other situations, protective orders may have been improperly applied or may be the result of false allegations. In these cases, we can work to modify or remove these orders, creating more equitable circumstances for you and your family.

Modification of Prior Orders

Because financial and other conditions may change over time, divorce decrees in Texas are eligible for review and modification every three years. Divorce decrees can be modified if the petitioner can demonstrate a significant change in circumstances. Changes in circumstance that warrant a modification of a divorce decree may include large increases or decreases in income, changes in health, or the development of a situation that may affect the well-being of any children.

If you are seeking a modification of your divorce decree, or if you are defending yourself against a request for modification, the attorneys at Coldwell | Bowes have the experience to quickly grasp the complex issues involved in your divorce and to effectively fight for your best interests and the best interests of your family.
